Terms and conditions

 

The terms and conditions below apply to all coaching and mentoring services provided by Evy Coupe (“the coach”), to any individual or organization (“the client”) and constitute the contract for the service to be provided by Evy for the client. 

By purchasing coaching services from Evy Coupe (“Coach”), you agree and consent to the following legal terms and conditions that govern your use of the coaching services and that form a legal agreement between you and the Coach.

PURCHASING REQUIREMENTS

You must be at least 18 years of age or older to purchase the coaching service with the Coach. The coaching service is available for individual purchase only. Friends, family, partners, colleagues, etc, will need to purchase the coaching service individually. You are expressly prohibited from sharing access to the content of the coaching service with anyone else. Additionally, you have no right to assign this Agreement as this coaching service is non-transferable.

COACHING DISCLAIMER 

In committing to the coaching services with me, you acknowledge the following:

  • You understand that the coaching services you will be receiving from your Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that your Coach is not acting as a mental health counselor or a medical professional.
  • For legal purposes, you understand that coaching is currently an unregulated industry and that your Coach is not a “licensed” professional.
  • You understand and agree that you are fully responsible for your well-being during your coaching sessions and subsequently, including your choices and decisions.
  • You understand that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and you will not use it in place of any form of therapy.
  • You understand that all comments and ideas offered by your Coach are solely for the purpose of aiding you in achieving the defined goals you create with your Coach. You can give your informed consent and hereby give such consent to your coach to assist you in achieving such goals and understand that results are not guaranteed.
  • You understand that to the extent our work together involves personal and spiritual development, career or business. Your Coach is not promising outcomes but is not limited to personal introspection, increased personal happiness, career progression, profitability, and/or business success.

DATA PROTECTION

You understand that your Coach will protect your information as confidential unless you state otherwise in writing. If you report child abuse, elder abuse, or neglect or threaten to harm yourself or someone else, you understand that necessary actions may be taken and your confidentiality agreement may be limited in this capacity. Furthermore, if your Coach is ordered by a court to provide information or to testify, she will do so to the extent the law requires.

DATA SECURITY

You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of email, text, phone, WhatsApp, Zoom, and/or any other technology. 

TERMS AND CONDITIONS REGARDING 1:1 COACHING 

The coaching schedule will be arranged between the Coach and the client and can be booked up to 2 months in advance. The coaching program with Evy consists of 8 weeks of one-on-one coaching. The date that the first coaching session takes place shall be deemed to be the start date for the service. Where any client is unhappy with any of the terms and conditions they can contact Evy to discuss any concerns and see if they can be resolved before the first coaching session. Participation by any individual in the first coaching session constitutes acceptance of these terms and conditions. 

DISCONTINUANCE OF SERVICES. 

Your decision to undergo coaching is voluntary. You understand that you are free to discontinue at any time subject to our cancellation policy.

FORMAT OF SESSION

Session is done mainly through Zoom video communication. In all cases, the client is responsible for attending the coaching calls through the provided links by the coach. The coach is open to other formats by mutual agreement. The coach is responsible for ensuring that she is available for coaching at agreed times.
The length of each session is set to 60 minutes at the time of booking on the appointment booking platform and paid for in advance when purchasing the eight-week coaching program. Sessions may be overrun by mutual agreement and paid for retrospectively, but only if the Coach has no commitments immediately following the session.

The Coaching Program is created and sold as whole packages and cannot be altered or partially completed in any way. There is a minimum term of eight weeks of 1-1 Coaching.

SESSION FEES

Evy’s current fees are mentioned on the website and made clear before the time of purchase. Evy reserves the right to change the fees from time to time. Payment prices for the eight-week coaching program are paid in advance either in full or through the payment plan. When the client purchases the eight-week coaching program through a payment plan, payments need to be done accordingly. If any installment payment should default, the Client will have seven days to rectify the situation. Any scheduled coaching session(s) will be postponed until payment is received within 7 days, all discounts and bonuses will be forfeited and full payment will apply. If a Client should default on any installment payment, the result may be cancellation of the Program and the Cancellation Policy will apply. Any credit card decline will result in a penalty from our payment processing company in cases of payment default and may result in additional fees being applied.

MISSED SESSIONS/CANCELLATIONS/RESCHEDULING POLICY

If you need to reschedule a reserved Coaching session, you must do so at least 24 hours in advance of your scheduled session. All notices of cancellation must be in writing and delivered by email to [email protected]. If you reschedule a Coaching session with less than 24 hours’ notice, then you will forfeit your session fee.

You may only request a reschedule up to 3 times. If you fail to make an appointment after your 3 attempts you will forfeit your session fee. No refunds will be granted for canceled sessions or under any other circumstances. The coach reserves the right to reschedule Coaching sessions and will coordinate a new time with you for such sessions. No refunds will be granted for sessions rescheduled by the coach. 

If you paid the program fee and aren't satisfied with the style of coaching after your first call you can cancel the ongoing coaching and ask for a full refund, only under the condition that you cancel ongoing coaching after your first session and within 24 hours after the session ended. No refunds, credits, or transfers will be given once the 24-hour mark of notice is exceeded. You can cancel and claim your full refund by email to [email protected].
